Nightcap Rural Land Sharing Communities

A Development Application for  Nightcap on Minjungba l was refused by  Tweed Shire Council in May 2020 for several reasons, including lack of Council permission for road construction. A new request for permission to construct road access has been submitted by Nightcap Rural Land Sharing Communities Development .  The proposal requests permission for road works and earthworks to upgrade the access to the proposed development from Kyogle Road, with  associated road works, earthworks and vegetation removal over 11 stages. The current request is only for Stage 1 of the proposed development, requiring access to nine proposed " Rural Land Sharing Communities" with a total of 393 dwellings. Two further access roads connecting a total of 867 dwellings are proposed for future stages. The request will be discussed by  Tweed  Council in a meeting on September 17. "The Minjungbal people are happy..." Nightcap Village is offering a special deal on "Sacred" . Dwelling sites on Mt Burrell properties are marketed with a new website by "sacred people" offering "sacred solutions for these sacred times" on "sacred land" . For those who were lured into the incipient venture from 2014-2017, this supposed sacred land has certainly left many people running scared.  A promotional video published online by Nightcap Realty is  selling a lifestyle dream with a social justice vision and a reverential greeting,  "Welcome to Country!" Vincents Notice to Creditors: Bhula Bhula Intentional Community

By Gi Linda- Following is the text of a notice to creditors by Vincents' liquidator, Steven Staatz, who is receiver of contested property at 3222 Kyogle Rd, Mt Burrell, NSW. 3222 Kyogle Rd, Mt Burrell, NSW The notice from Steven Staatz informs creditors and interested persons who are waiting with hands outstretched to receive a crumb from sale of the property, that the purchaser has been unable to complete the sale. An additional deposit of $100,000 has been paid and the purchaser, Derek Zillman, is allowed until October 19 to seal the deal. I am one of twenty disenfranchised investors who provided purchase money in exchange for co-ownership of land between 2014-16, without receiving consideration or restitution. I am also a judgment creditor of  the company,  after filing a successful statutory demand in 2017 in Qld Federal Court. I did not receive a copy of the notice sent by Vincents on September 1.  Perhaps an oversight, or maybe I no longer receive not...

Google Corp has summarily removed most of the posts on  "Nightcap Nightmare Blog"  in response to a request by lawyer Billy Fitzgerald, Rose Litigation, whose clients are featured in this blog and the book  "Nightmare on Minjugbal" . The posts have been censored because they supposedly violate injunctions imposed by NSW Supreme Court on disenfranchised investor Gi Linda, the co-author and editor of this blog, who is prohibited from imputing fraud to Billy Fitzgerald's clients with regard to their land-share scheme at Mt Burrell that is now called "Nightcap on Minjungbal" . The gag order is based on Judge Fagan's 2019 decision that although more than 20 investors lost life savings when they paid purchase money for land in 2014-16, and received nothing in return, this cannot be described as a " scam ".  Fagan J reasoned that failure to fulfil marketing representations was a consequence of incompetence, and not deception or fraud by Mr Fitzg...

Commenting on "Paleo Pete's" recent induction into the tribal experience, radio host Ray Hadley on his Morning Show , Aug 31, describes the notable failure of the venture when, in 2015-17, it was called "Bhula Bhula Village Community" :  "A Federal Court Judge described efforts to establish the community as 'shambolic'" . Ray Hadley said those involved "failed to reach the heights of a careless enema" . He warned: "The last time they went down this road, (without this dolt being involved) someone lost $2.5 million. The Courier Mail, Aug 31, 202  Celebrity Chef Pete Evans has announced his new life in the off-matrix "Byron Tribal Community" that he has bought into.  He doesn't mention the backstory to the " Tribal Community" or the families who lost life savings following the same dream. He doesn't seem to mind that no compliant development application has been made to Tweed Council since the venture began in 2014. He doesn't even mention the ongoing litigation by investors who lost everything when marketing representations were not fulfilled by his new business partner, Adrian Brennock. Pete Evans may be the new kid on the Byron block, but for those who bought the Bhula-Nightcap dream and got stung by the stories, there is much more to be told that soon will be revealed.
